Mailu has told the Senate Health Committee that his PS derailed the whole discussions to end the impasse.

The government is now taking a new turn in the ongoing doctors strike, just a day after the  Kenya Medical Practitioners And Dentists Union (KMPDU) were sentenced to a one month jail term.

Speaking after honoring the sermon to appear before the Senate Committee on Health on Tuesday, Health Cabinet Secretary Cleopa Mailu has said the government will petition the Court of Appeal to free seven jailed officials of the doctors’ union.

Mailu told the Migori Senator Dr Wilfred Machage led Senate Committee on Health that the government would “do all within its powers to get the seven freed” after the Employment and Labour Relations court  sent the seven to jail Monday for contempt.

And in what seems to be an in-fight between the CS and the PS, Mailu has told the committee that his PS, Dr Muraguri, opted out of talks two days after he appointed him to lead the talks on behalf of ministry.

The Kenya Medical Practitioners, Pharmacists and Dentists and Union officials serving month-long jail terms are Samuel Oroko (Chairman), Ouma Oluga (Secretary General) among other officials Daisy Korir (Treasurer), Titus Ondoro (1st Vice Chairman), Allan Ochanji (2nd Vice chairman), Mwachonda Chibandzi (Deputy Secretary General) and Evelyne Chege.

Mailu has defended himself before the committee saying that he has been cooperating with the negotiations over the contentious Collective Bargaining Agreement entered between the jailed doctors and the government in 2013.

Earlier, however, the Senate Health Committee termed the CBA illegal as it had not been signed by the court.

He also revealed that all County Health Executives from across the country are in Nairobi to assess the situation in hospitals and come up with a way forward on the crisis.

Mailu says a sticking point in the talks was a demand by the union to include Kenyatta National Hospital, Moi Teaching and Referral Hospital and KEMRI in the CBA.

He argued that the 2013 CBA is defective since the Salaries and Remuneration Commission had not given it the go ahead and the County Governments were not involved.

Mailu’s sentiments come two days after the appointed mediator who is also the General Secretary of the Central Organisation for Trade Unions in Kenya (COTU) Francis Atwoli, hinted at in-fights between CS Mailu and his PS.

Atwoli termed the in-fights as the major blow to the would be negotiations to end the three-months running stalemate.

Meanwhile, the Kenya Medical Association (KMA) on Tuesday revoked Health CS Cleopa Mailu’s and PS Muraguris’s membership for failing to side with the doctors who are on strike effective one year.

Health PS Nicholas Muraguri has been summoned to accompany his boss and appear before the Senate Health Committee for questioning on Wednesday.
